These Terms of Service ("Terms") govern your use of BerryShifts, the franchise operations platform operated by BerryShifts. By creating a workspace or using the service you agree to these Terms.
1. The service
BerryShifts provides operational tooling for multi-location businesses — checklists with proof, incident reporting, document compliance, announcements, shift scheduling and audit reports. We may improve or modify features over time; we will not materially reduce the core functionality of your plan during a paid term.
2. Accounts & workspaces
You must provide accurate information when signing up and keep your credentials confidential. You are responsible for the activity of the users you invite into your workspace. Workspace owners control their team's access and their data.
3. Trials, billing & cancellation
- Paid plans start with a free trial (length shown at signup); no card is required to start.
- After the trial, Starter and Growth are billed per location through Stripe. Starter starts with 1 paid location; Growth starts with 2.
- You can upgrade, downgrade or cancel at any time; changes are prorated. Cancelling stops future charges — fees already paid are non-refundable except where required by law.
4. Your data
Everything your team enters into your workspace is yours. We claim no ownership over it, and we access it only to operate and support the service. After cancellation you have 30 days to export your data before it is scheduled for deletion, as described in our Privacy Policy.
5. Acceptable use
You agree not to misuse the service — including attempting to breach its security, reselling it without authorization, uploading unlawful content, or using it to infringe the rights of others. We may suspend workspaces that put the platform or other customers at risk.
6. Availability & support
We work to keep the service available around the clock but do not guarantee uninterrupted operation. Planned maintenance is announced in advance where practical. Support is provided by email at the address below.
7. Disclaimer & limitation of liability
The service is provided "as is". To the maximum extent permitted by law, BerryShifts is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amounts you paid us in the twelve months before the claim arose. BerryShifts helps you document compliance — it does not by itself guarantee compliance with laws or franchisor requirements applicable to your business.
8. Termination
You may stop using the service at any time. We may terminate or suspend access for material breach of these Terms if the breach is not cured within a reasonable notice period.
9. Changes to these Terms
We may update these Terms; material changes will be posted here with an updated date, and continued use after the effective date constitutes acceptance.
